PRODUCT TERMS

Please read these Product Terms (the "Terms") carefully. Your use of the Site or Scholastic Products (as defined below) constitutes your consent to these Terms.

These Terms are between you and Scholastic Inc. and/or any affiliated entities set forth in an applicable Order (“Scholastic” or “we”) concerning your use of (including any access to) the text, images, audio and audiovisual recordings, software, databases, documentation and other information, content, material and services (the “Scholastic Products”) made available to you through the Scholastic websites and mobile apps displaying a link to these Terms (together with any successor website(s) and app(s) thereto, the “Site”). These Terms hereby incorporate by this reference any additional terms and conditions posted by Scholastic through the Site, or otherwise made available to you by Scholastic.

If you have entered into an Individual Customer Agreement or Institutional Customer Agreement with Scholastic (currently available upon request as described in the “Information or Complaints” section below, and referred to herein as a “Customer Agreement”), then please note that (1) these Terms are incorporated into such Customer Agreement, and (2) as used in these Terms, the word “you” means both Customer and any other Users permitted to use the Site and Scholastic Products under the applicable Order, as defined in the Customer Agreement.

BY USING THE SITE OR THE SCHOLASTIC PRODUCTS, YOU AFFIRM THAT YOU ARE OF LEGAL AGE TO ENTER INTO THESE TERMS, OR, IF YOU ARE NOT, THAT YOU HAVE OBTAINED PARENTAL/GUARDIAN OR TEACHER/LIBRARIAN CONSENT TO DO SO.

INSTITUTIONAL CUSTOMER AGREEMENT

This Institutional Customer Agreement (the “Agreement”) is made as of the Effective Date (as defined below) by and between Customer (as defined below) and Scholastic Inc., located at 557 Broadway, New York, NY 10012, and/or any applicable affiliated entities set forth in an Order with respect to particular Licensed Products, each as defined below (“Scholastic”). This Agreement includes the Product Terms (as updated by Scholastic from time to time), which are currently available above (Product Terms) and are hereby incorporated into this Agreement by reference.

By accessing or using the Licensed Products (as defined below), or by otherwise indicating your acceptance of this Agreement (for example, by clicking “I Agree” or through another mechanism confirming your acceptance), Customer is agreeing to be bound by this Agreement, and you represent and warrant that you have the legal authority to bind Customer to this Agreement. Please note that your Internet browser will typically permit you to print or save a copy of this Agreement.

 

SCHOLASTIC EDUCATION TECHNOLOGY PRODUCTS PRIVACY POLICY

For more than 90 years, Scholastic Inc. has been delivering outstanding educational programs directly to schools and libraries, and we cherish our partnership with educators. Serving them and the children they teach is at the heart of everything we do. We are committed to providing quality, engaging educational content to our school district customers. We are similarly committed to ensuring that our customers understand how we use and disclose the information we collect in the course of providing our educational software products (our “Products”) to their administrators, teachers, and students. Our Products include online services and applications. We have prepared this Privacy Policy to describe our practices.

As described below, we use the information we collect from school administrators, teachers, parents, guardians, and students in connection with their use of our Products to provide the Products and related services to our school district and library customers and to inform and improve instruction and our Products. We do not use personal information—that is, information that identifies an individual or relates to an identifiable individual—for any other purpose.

We do not, however, disclose any personal information about the users of our Products to any third party, except:

THIRD PARTY SERVICES

This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any site or service to which our Products may link. The inclusion of a link in any of our Products does not imply our endorsement of the linked site or service. In addition, we are not responsible for the privacy, information or other practices of other organizations, such as Apple, Google, Microsoft, RIM, or any other device manufacturer, app developer, or provider of an app, social media platform, operating system, or wireless service.

SECURITY

We seek to use reasonable organizational, technical, and administrative measures to protect personal information within our organization from unauthorized access, use, disclosure, loss, or modification.

USER ACCESS

The law may permit students and their parents or guardians to access certain of their own information. If you would like to seek such access, please contact your school district.

RETENTION PERIOD

We will retain personal information collected in connection with the Products for the period necessary to fulfill the purposes outlined in this Privacy Policy and in our agreement with our school district customer.

UPDATES TO THIS PRIVACY POLICY

We may change this Privacy Policy. The “Last Updated” legend at the top of this page indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy or provide it to our school district customer, which accepts the Privacy Policy on behalf of our Products’ end users. Any changes will become effective when we post the revised Privacy Policy or, in the case of any material change, provide the revised Privacy Policy to our school district customer, which agrees to the Privacy Policy, and any revisions to it, on behalf of its administrator, teacher, parent or guardian, and student end users.

Certain educational software products and their related mobile applications and marketing sites listed in the chart below are now owned and operated by Houghton Mifflin Harcourt (“HMH”), 222 Berkeley Street, Boston, MA 02116, privacy@hmhco.com, telephone (800) 323-9239, and “we” and “our” shall refer to HMH in the context of such products and sites. Scholastic Inc. will provide services to HMH in connection with such products and marketing sites for a period of up to two years in connection with the transition of the ownership of such products from Scholastic Inc. to HMH. Inquiries regarding data collection or privacy practices for such products or sites should be directed to privacy@hmhco.com. The educational software products that continue to be owned and operated by Scholastic or one its affiliated companies are listed on the chart below, and “we” and “our” shall refer to the applicable Scholastic entity in the context of such products and sites.
